That goes to show that the ATF does there job and don't mess around. I wounder how he got caught. Maybe no contigency letter or word of mouth?

I can tell you that this guy most likely did not go to kellners and pick this stuff up and i am pretty sure he does not have a license to buy either

I searched my ATF fireworks license list and I do not see his name. That could mean a few things. He could have the ATF license in a business name or someone else is involved. I can guarantee you this started as legal purchase and where it went from there who knows.

It looks like drugs were found also.
ALHALLA, N.Y. -- Westchester County, N.Y., police said they found cocaine in the home of a Valhalla, N.Y., man when they busted him with eight tons of illegal fireworks this week — and have arrested one of his children on a felony drug charge.

David Surace, 30, was charged late Wednesday with third-degree criminal possession of a controlled substance, a felony, and seventh-degree criminal possession of a controlled substance and criminally possessing a hypodermic instrument, misdemeanors.

A friend of mine knew him and he did not have a ATF license im sure he had a few connections. Can Kellners be held responsible for this or once they leave the store it is out of there hands ???

This scenario leaves so much room for speculation it should be interesting to see what the outcome will be. If this person was selling just 1.4 consumer fireworks, I highly doubt the ATF would even be involved in this. Once you add 1.3 fireworks into the mix this is the critical downfall of selling fireworks on the black market. I would love to see an itemization of the 1.3 product. The pictures I found show the large display shells from Mexico. If I were to speculate what is in demand on the black market it would be 1.75 salutes. Who wants 8 and 10-inch shells? If he was selling just 1.4 products, I do not think this would be a big deal. You would be amazed how many people that are big in the fireworks business now, started out this way.
After I posted my video “Buying Fireworks and the Ride Home”, I received many responses about movement of fireworks products. Whatever revealed to me I keep confidential. States and stories that come to mind are usually California , New York and Hawaii. To speak generically one story involved a weekend of gambling in Las Vegas and returning back to California with a large truck full of fireworks, another is fireworks from Russia making their way to Hawaii, shipping ports in United States where overloaded fireworks are brought in, label machines creating 1.4 labels for 1.3 products. Etc.
If you search back through some of the legal cases here in Pennsylvania where I live, Phantom Fireworks settled multiple cases with the attorney generals office in Pennsylvania for marketing fireworks from Ohio to Pennsylvania back in the day. I remembered reading one where they settled one for $200.00. Although I do not think this guy in New York will be so lucky.
Everyone should know the ATF is now selling confiscated 1.3 fireworks.

No. They we're bought legally at the point of sale. It's NY's problem to deal with, not the state's or vendor's where they we're bought.

True - very true. The original purchase was indeed a VERY LEGAL PURCHASE!!! I must highly emphasize that. Like Dave said earlier as well - where it went from there is anyone's guess. As far as the 1.4 stuff - this dude could buy from Kellner or ANYONE in Pa legally - so that is not a Issue here either.

I am just in shock by the amount of product he had stored at his home, I see a lot of 1.4 cases, also 1.3 cases with Carter Bell on them. A lot of the open shells appear to be from Mexico. It's people like this that make the laws on people that do things by the book so tough!
